TERMS AND CONDITIONS

Clear agreements for a warm and professional working relationship

At Mothers & Moon, we believe that clear agreements bring peace of mind and trust. These terms are not intended to create distance, but to clarify what we can expect from one another. This leaves as much space as possible during our work together for what truly matters: safety, connection and personalised care.

By booking support, a consultation, workshop, women’s circle, ceremony or any other service, the client confirms that they received and accepted these terms and conditions before entering into the agreement.

IMPORTANT

An individual quotation or support agreement may contain additional or different arrangements. In the event of a conflict, the individually signed agreement takes precedence, insofar as the departure is permitted by law.

1. Identity and scope

1.1 Identity

Mothers & Moon – Lindsay Danthine
Vennestraat 2D, 9230 Wetteren, Belgium
Business registration and VAT identification number: BE 0637.779.948
Email: info@mothersandmoon.be
Telephone: 0472 86 03 57
Website: www.mothersandmoon.be
Business bank account: BE62 1036 1107 9961

1.2 Scope

These terms apply to all professional services and materials provided by Mothers & Moon, including:

  • doula and postpartum support;

  • birth plan, rebozo and birth partner consultations;

  • workshops, women’s circles and other group activities;

  • Mother Blessings, Baby Blessings, Closing the Bones and other rituals or ceremonies;

  • placenta prints and other additional support or materials agreed in writing.

‘Client’ means the natural person who books a service for non-professional purposes and, where relevant, their birth or life partner. Where another person makes or pays for the booking, the person receiving the service also remains bound by the practical arrangements applicable to the support.

2. Enquiry, booking and agreement

2.1 Enquiry and introductory meeting

An enquiry may be made through the website, by email, telephone, WhatsApp or another agreed method. An enquiry or introductory meeting is without obligation and does not yet constitute a confirmed booking.

Where appropriate, we first consider whether the support meets the family’s needs and fits the expertise, availability and approach of Mothers & Moon.

2.2 When is a booking confirmed?

A booking is confirmed only when:

  • both parties have agreed on the service, date or support period;

  • the individual agreement or quotation, where applicable, has been signed;

  • the agreed first payment or deposit has been received; and

  • Mothers & Moon has confirmed the booking in writing.

Until that confirmation, the requested date or period cannot be guaranteed.

2.3 Refusal or termination by Mothers & Moon

Mothers & Moon may decline an enquiry or end a working relationship when safe, respectful or high-quality support cannot reasonably be provided. This may include a request outside its expertise or service area, lack of availability, repeated failure to honour agreements or payments, inappropriate behaviour, a serious breakdown of trust or circumstances that compromise safety.

Any refusal or termination will be explained and communicated respectfully. Where possible, we will help identify an appropriate referral.

Where Mothers & Moon terminates the agreement, a transparent settlement will follow: only services already provided, demonstrably incurred costs and support phases already begun or reserved remain payable. Any balance for services not provided will be refunded within fourteen calendar days, except where termination is the direct result of a serious contractual breach by the client and the law permits a different settlement.

3. Prices, travel and payment

3.1 Prices and VAT

Current prices are stated on the website, in the price guide, quotation or individual agreement. All amounts are in euros.

Mothers & Moon is subject to the special VAT exemption scheme for small businesses. VAT does not apply.

Invoices and payment documents state: ‘VAT not applicable – small business exemption scheme.’

Price changes apply only to new bookings and do not affect bookings already confirmed in writing or existing agreements.

3.2 Travel and parking costs

Travel within a radius of 20 kilometres of Wetteren is included, unless otherwise agreed in writing. Beyond that radius, €0.40 is charged per kilometre travelled.

Necessary parking, tolls and similar travel costs are charged at their actual cost. The client informs Mothers & Moon in advance about paid parking, restricted access or other relevant accessibility arrangements.

3.3 Payment by service

Unless the individual agreement states otherwise:

Doula package: total price €1,350, paid in three instalments of €450: on signing, around the second prenatal consultation and at the start of the on-call period at 37+0 weeks.

Consultations, workshops and women’s circles: the full amount is paid in advance.

Mother Blessing or Baby Blessing: a €150 deposit on booking; the balance no later than fourteen calendar days before the ceremony. For a booking made within that period, the full amount is due immediately.

Postpartum support and other tailored services: payment dates are agreed in writing in advance in the quotation or agreement.

Payment is made by bank transfer to BE62 1036 1107 9961, using the reference stated on the invoice or payment request.

Invoices are payable within seven calendar days of the invoice date, unless another due date is stated in writing. A service for which advance payment has been agreed need not begin until payment has been received.

3.4 Late payment by a consumer

If payment has not been made by the due date, the client first receives a free reminder. A new payment period of at least fourteen calendar days then applies in accordance with Book XIX of the Belgian Code of Economic Law. No charges or interest are applied during that statutory waiting period.

If payment is still outstanding afterwards, the following become payable by operation of law and without a further formal notice, within the limits permitted by law:

  • late-payment interest at no more than the reference interest rate plus eight percentage points, as referred to in the Act of 2 August 2002 on combating late payment in commercial transactions; and

  • a fixed compensation payment of no more than €20 for an outstanding amount up to and including €150; €30 plus 10% of the portion between €150.01 and €500; or €65 plus 5% of the portion above €500, subject to an absolute maximum of €2,000.

This fixed compensation covers the costs of amicable debt collection. Mandatory legal rules always take precedence. If a payment is disputed, please notify us in writing as soon as possible, stating the reasons.

4. Right of withdrawal for distance or off-premises contracts

4.1 Period and exercise of the right

When a consumer concludes a distance contract, for example through the website, by email or telephone, or away from the usual business premises of Mothers & Moon, they generally have fourteen calendar days to withdraw from the contract without giving a reason. The period starts on the day after the service contract is concluded.

Withdrawal may be notified using the model form at the end of these terms and conditions or by another unambiguous statement sent to info@mothersandmoon.be or by post to Vennestraat 2D, 9230 Wetteren.

It is sufficient for the notice to be sent before the period expires.

4.2 Services during the withdrawal period

If the client wants the service to begin during the withdrawal period, an express request is required.

If the client withdraws after performance has begun at their request, Mothers & Moon may charge a proportionate amount for the part performed up to withdrawal.

Where the service has been fully performed before the period ends, the right of withdrawal is lost only after the client has expressly agreed in advance to full performance and acknowledged that they would thereby lose the right of withdrawal.

4.3 Statutory exceptions and refunds

A statutory exception may apply to certain leisure services provided on a specific date or during a specific period. Where that exception applies, the client will be clearly informed before booking. This provision does not restrict any mandatory consumer right.

Following a valid withdrawal, Mothers & Moon refunds the amounts received that must be repaid under the law within fourteen calendar days, in principle using the same payment method.

The arrangements in section 5 apply only after the right of withdrawal has expired or where a statutory exception applies.

5. Changes, cancellations and rescheduling

We understand that pregnancy, birth and family life cannot always be planned. We therefore seek a compassionate solution wherever possible. At the same time, some services require preparation, materials or a date to be kept available.

The following arrangements apply subject to mandatory law, a valid right of withdrawal, force majeure or a different written agreement.

5.1 Consultations

More than five calendar days before the appointment: cancellation or one rescheduling free of charge.

Less than five calendar days before the appointment: 50% of the agreed amount remains payable.

Non-attendance without prior notice: the full amount remains payable.

5.2 Big sibling workshop and other workshops

More than five calendar days in advance: cancellation or one rescheduling free of charge.

Less than five calendar days in advance: 50% remains payable.

Within 48 hours or in the event of non-attendance: the full amount remains payable.

5.3 Women’s circles

Participation may be moved once to the next available women’s circle if cancellation is notified at least five calendar days in advance.

For a later cancellation or non-attendance, a refund or transfer is not possible, unless the place is subsequently filled and Mothers & Moon agrees to an exception in writing.

If Mothers & Moon cancels the activity, the participant may choose between a new date and a full refund.

5.4 Mother Blessings and Baby Blessings

After any right of withdrawal has expired, the €150 deposit is allocated to preparation and reserving the date. It may be transferred once to a new date, subject to availability.

For a Mother Blessing, that date must fall within the same pregnancy or, at the latest, the fourth trimester; for a Baby Blessing, no later than twelve months after the original date.

More than fourteen calendar days before the ceremony: only the deposit remains payable.

Less than fourteen calendar days before the ceremony: the deposit and 50% of the remaining balance remain payable.

Within 48 hours or in the event of non-attendance: the full amount remains payable.

The client provides a suitable and safe location and, for an outdoor venue, preferably a workable alternative in the event of bad weather.

The client remains responsible for guests, children, catering, drinks, personal belongings and damage caused by those present. Mothers & Moon may interrupt or end an activity if safety, wellbeing or mutual respect is seriously compromised.

5.5 Cancellation by Mothers & Moon

If Mothers & Moon has to cancel a consultation, workshop, women’s circle, ritual or other scheduled service, a suitable new date will first be proposed.

If this is not possible or the client does not wish to accept it, the amount for the part not provided will be refunded within fourteen calendar days. Other reasonable solutions may be agreed only by mutual written agreement.

6. Specific arrangements for doula support

6.1 Scope of the package

The doula package comprises the elements stated in the individual support agreement, generally including three prenatal consultations, availability between appointments, an on-call period, birth support and a postpartum visit.

Support is personal and tailored to the family, without a guarantee of a particular birth process or outcome.

6.2 On-call period and availability

The on-call period generally starts at 37+0 weeks of pregnancy, unless otherwise agreed in writing. From that point, Mothers & Moon can be reached 24 hours a day for matters relating to the approaching birth.

For urgent developments, the client calls. If the call is not answered immediately, the client leaves a voicemail and sends a text or WhatsApp message.

The client reports as soon as possible if their waters break, regular contractions begin, they are admitted to hospital, labour is induced, a caesarean birth is scheduled, the due date changes or another relevant development occurs.

Before 37+0 weeks, Mothers & Moon will make every effort to be present, but attendance cannot be guaranteed.

6.3 Rapid birth, late notification and a change of choice

The third instalment covers both the reserved on-call period and birth support. Once the on-call period has begun, this instalment generally remains payable if the birth progresses exceptionally quickly, Mothers & Moon cannot arrive in time despite reasonable efforts, the client gives late notice or the client decides not to use birth support.

If absence was avoidable and attributable to Mothers & Moon, and no backup or meaningful alternative can be provided, a reasonable and transparent settlement will be made for the part not provided. The on-call period and support already provided will be valued separately.

6.4 Backup doula

Mothers & Moon works with a carefully selected backup doula as standard. In the event of illness, force majeure, simultaneous births or another exceptional impediment, the backup may take over the support.

Relevant information is shared only insofar as necessary and in accordance with the privacy policy and individual agreement.

If the backup is also unavailable due to force majeure, Mothers & Moon makes every reasonable effort to find a solution. An absolute guarantee of a replacement cannot be given in such exceptional circumstances.

6.5 Hospital, caesarean birth and medical decisions

Access to a hospital, delivery room, operating theatre or other care setting depends on the rules and decisions of the relevant healthcare institution and medical team.

Mothers & Moon is not liable if access or attendance is restricted for that reason. Where possible, support continues before or after the procedure.

6.6 Ending the doula package

After any right of withdrawal has expired, the client may end the package in writing. Phases already begun or completed, demonstrable costs and availability reasonably reserved remain payable. Phases not yet begun are no longer payable.

Any overpaid balance is refunded within fourteen calendar days.

In the event of pregnancy loss, stillbirth or the death of a baby, we always first seek a compassionate solution that respects the circumstances and the family’s needs.

7. Responsibilities and communication

7.1 Responsibilities of Mothers & Moon

Mothers & Moon carries out every assignment carefully, professionally, respectfully and within its expertise.

The support is an obligation to use reasonable care and effort: we commit ourselves with care, but cannot guarantee a specific outcome.

7.2 Responsibilities of the client

The client provides accurate contact, health and practical information relevant to the support in good time, reports important changes and provides a safe, accessible working environment.

The client remains responsible for their own choices and for following medical advice. Incorrect or incomplete information may limit the support if it prevents Mothers & Moon from reasonably acting safely or appropriately.

7.3 Digital communication

Email, telephone, text messages and WhatsApp are accepted communication channels. The client keeps their contact details up to date and reads incoming messages promptly.

Mothers & Moon responds to messages as soon as possible, but ordinary digital communication is not a permanent emergency channel. In a medical emergency, the client contacts a qualified healthcare professional or the emergency services.

8. Force majeure

Force majeure is an unforeseeable and unavoidable event beyond the reasonable control of the party concerned that makes performance temporarily or permanently impossible.

Examples may include serious illness or an accident, hospital admission, the death of a loved one, extreme weather, natural disasters, epidemics, government measures, strikes, serious traffic incidents or technical failures beyond reasonable control.

The affected party informs the other as soon as possible and limits the consequences where reasonably possible. Obligations are suspended for as long as the force majeure continues.

The parties first seek rescheduling, a replacement or another suitable solution. If performance becomes permanently impossible, there will be a reasonable settlement of services already provided, demonstrable costs and parts not performed.

Force majeure excludes liability only insofar as non-performance was directly caused by it.

9. Role, medical boundaries and liability

9.1 Non-medical role

Mothers & Moon provides emotional, practical and informational support. This never replaces medical care or the advice of a doctor, midwife, gynaecologist or other qualified healthcare professional.

Mothers & Moon does not diagnose, carry out medical procedures, prescribe medication or make medical decisions on the client’s behalf.

If there is uncertainty about the health or safety of the mother, baby or another participant, the client is referred to the appropriate healthcare professional or, in an emergency, the emergency services.

Decisions and actions of healthcare professionals, hospitals and other independent third parties are outside the control of Mothers & Moon.

9.2 Liability

Mothers & Moon is liable for directly proven damage resulting from an attributable contractual or non-contractual fault, within the limits of applicable law.

To the extent permitted by law, Mothers & Moon is not liable for indirect or consequential damage that was not reasonably foreseeable, nor for damage resulting solely from incorrect information provided by the client, decisions of third parties or circumstances beyond the reasonable control of Mothers & Moon.

No provision excludes or limits liability for intentional misconduct or gross negligence by Mothers & Moon or persons for whom it is legally responsible, for death or personal injury, or in other cases where exclusion or limitation is prohibited by law.

Where professional liability insurance provides cover, the claim is handled in accordance with the policy and legal rules. The insurance does not affect the client’s mandatory rights.

Mothers & Moon holds professional liability insurance with P&V Verzekeringen, policy 32.744.523, effective from 2 October 2026. Cover is subject to the policy’s terms, limits and exclusions.

10. Privacy, confidentiality and images

10.1 Confidentiality and personal data

Personal conversations and information are treated discreetly and confidentially.

Data are shared only where necessary to perform the agreement, with carefully selected service providers or a backup doula, following express consent, or where a legal obligation or the protection of vital interests requires it.

Mothers & Moon processes personal data in accordance with the GDPR and the privacy policy at www.mothersandmoon.be. This sets out, among other things, the purposes, legal bases, recipients, retention periods and rights of data subjects.

Privacy enquiries can be sent to info@mothersandmoon.be.

10.2 Photographs, videos and testimonials

Identifiable photographs, videos or testimonials are used for communication or marketing only after separate, freely given, specific and demonstrable consent.

Consent to take images and consent to publish them are requested separately where necessary. For identifiable minors, the required consent of the legal representative(s) is necessary.

Consent may be withdrawn at any time as easily as it was given. Withdrawal does not affect the lawfulness of earlier processing, but future use based solely on that consent will stop.

A request for removal is handled in accordance with the GDPR and image rights.

11. Intellectual property

Texts, logos, illustrations, photographs, meditations, exercises, workbooks, downloads, courses, designs and other Mothers & Moon materials remain protected by intellectual property rights.

The client receives only a personal, non-transferable right to use the material for the purpose for which it was provided.

Without prior written permission, materials may not be copied, distributed, published, adapted, sold, used commercially or shared with third parties.

Personally completed documents, such as a birth plan, may of course be shared with the client’s own partner and involved healthcare professionals for the purpose of the support.

12. Complaints, mediation and applicable law

12.1 Complaints

A concern or complaint should preferably be reported in writing as soon as possible to info@mothersandmoon.be, with a clear description and relevant supporting documents.

Mothers & Moon acknowledges receipt and aims to provide a substantive response within fourteen calendar days. If more time is needed, the client will be informed.

12.2 Consumer Mediation Service

If a consumer and Mothers & Moon cannot reach a solution, the consumer may submit a case free of charge to the Consumer Mediation Service after first attempting to find a solution directly:

Consumentenombudsdienst
Koning Albert II-laan 8 bus 1
1000 Brussels
Email: contact@consumentenombudsdienst.be
Telephone: 02 702 52 00
Website: www.consumentenombudsdienst.be

An out-of-court procedure does not limit either party’s right to bring the matter before the competent court.

12.3 Belgian law and competent court

The agreement is governed by Belgian law. The parties first attempt to resolve a dispute by mutual discussion.

If this is unsuccessful, jurisdiction lies with the court that has territorial and subject-matter jurisdiction under mandatory Belgian rules. This provision does not deprive the consumer of any statutory protection.

13. Final provisions

13.1 Severability

If a provision is wholly or partly invalid or unenforceable, the remaining provisions continue to apply.

Where possible, the invalid provision will be replaced by a valid provision that comes closest to the original purpose without infringing mandatory law.

13.2 Amendments and applicable version

Mothers & Moon may amend these terms for future bookings.

For an existing agreement, the version accepted at the time of booking continues to apply, unless the parties agree in writing to a permitted amendment or a change in the law must apply immediately.

The current version is available at www.mothersandmoon.be.

13.3 Entry into force

These terms and conditions take effect on 14 August 2026.

Version 3.0
